Nexus - Terms of Service

1. Acceptance of Terms

By accessing or using Nexus, you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use the platform. These terms apply to all visitors, registered users, and others who access or use the service.

2. Description of Service

Nexus is an advanced charting and analytics platform providing financial data visualization, OANDA streaming market data, and proprietary indicator calculations. The platform is designed for informational, research, and educational purposes.

3. Digital Service Delivery & Fulfillment Policy

Nexus is a digital SaaS product. All features, chart access, indicators, and data streams are fulfilled electronically and immediately upon account registration and successful login. No physical goods are shipped. Access is provisioned instantly.

4. Pricing, Subscriptions & Refund Policy

Nexus is currently provided free of charge during its launch phase. Should paid tiers, premium subscriptions, or add-ons be introduced in the future: (a) fees will be disclosed prior to purchase, (b) payments will be billed in advance on a recurring cycle, and (c) all payments are non-refundable except as required by applicable law or explicit promotional terms. Subscriptions may be canceled at any time, taking effect at the conclusion of the paid billing period.

5. Not Financial Advice

Nothing on Nexus constitutes financial, investment, legal, or tax advice. All charts, signals, GEX levels, and indicators are computational representations provided solely for educational reference. Trading foreign exchange, indices, and derivatives carries substantial risk of financial loss. You are solely responsible for all trading decisions.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEXUS, ITS CREATORS, DEVELOPERS, AFFILIATES, OR DATA PROVIDERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, TRADING LOSSES, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE. UNDER NO CIRCUMSTANCES WILL NEXUS BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, DELAYED DATA, OR UNAUTHORIZED ACCESS. IN NO EVENT SHALL TOTAL LIABILITY EXCEED THE GREATER OF FIFTY US DOLLARS ($50.00) OR THE TOTAL AMOUNT PAID BY YOU TO NEXUS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Disclaimer of Warranties

NEXUS AND ALL CONTENT, MARKET DATA, AND INDICATORS ARE PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. WE EXPRESSLY DISCLAIM ANY GUARANTEE THAT MARKET DATA IS COMPLETE, ACCURATE, UNINTERRUPTED, OR FREE OF DELAYS OR TRANSMISSION ERRORS.

8. Acceptable Use & Account Security

You are responsible for maintaining the confidentiality of your credentials. You agree not to reverse-engineer, decompile, crawl, attack, or abuse platform APIs or upstream OANDA credentials. Violations will result in immediate permanent account termination.

9. Termination

We reserve the right to suspend or terminate any account or access to the platform at our sole discretion, without prior notice, for conduct that violates these Terms or harms other users, Nexus, or third parties.

10. Governing Law & Modifications
